Sales conditions

TERMS AND CONDITIONS OF SALE

The sale will be conducted in Euros and is payable immediately.

The buyer’s premium amounts to 28.8% incl. VAT, to which a 1.8% live bidding fee will be added for bids placed online.

1. WARRANTIES

Attributions and period designations are made based on the state of scientific and artistic knowledge at the date of the sale. These attributions are guaranteed for a period of five (5) years from the date of adjudication.

The statutory limitation period for any claim against the auction house ROSSINI is five (5) years.

The order of the catalogue will be followed.

ROSSINI may provide, upon request, photographs and information enabling buyers to assess the condition of the lots. No claims will be accepted once the hammer has fallen.

Catalogue illustrations are as accurate as possible; however, variations in color or tone may occur. Dimensions are provided for guidance only.

ROSSINI is covered by professional liability insurance and financial guarantees as required by law. All experts are likewise covered by professional liability insurance.

2. BIDDING

Absentee bids (except online-only sales):

Written bids must be submitted using the form provided in the catalogue and received no later than 24 hours before the sale, together with bank details and valid identification.

Absentee bids are a service offered to clients unable to attend the sale.

The Auction House will endeavor to execute bids under the best possible conditions. However, it shall not be liable for any omission, error, failure or improper execution of such bids, regardless of cause.

In the event of identical absentee bids, priority is given to the first received.

3. DEFAULT OF PAYMENT

In the event of non-payment or late payment exceeding 30 days, penalties amounting to 11.37% incl. VAT of the total invoice will be applied.

ROSSINI reserves the right to initiate any recovery action, including registration in the TEMIS database, and to claim damages covering at least the buyer’s and seller’s fees not received.

4. RESALE AT THE DEFAULTING BIDDER’S RISK

In accordance with Article 14 of the Law of July 10, 2000:

In the event of non-payment by the successful bidder, after formal notice has remained ineffective, the lot may be resold at the seller’s request at the defaulting bidder’s risk. If the seller does not make such a request within two months, the sale shall be automatically cancelled, without prejudice to damages owed by the defaulting bidder.

5. COLLECTION OF PURCHASES

Buyers are advised to collect their lots promptly to avoid storage charges.

Storage does not engage the liability of ROSSINI or the expert.

Storage fees apply from the 20th day following the sale (excluding weekends and public holidays):

  1. €5 excl. VAT per day per item
  2. €10 excl. VAT per day per piece of furniture

Collection is strictly by prior appointment.

Certain bulky items may not be available at ROSSINI premises and may be stored at our logistics center in Montargis, available by appointment only.

In the event of payment by cheque or bank transfer, delivery will only take place after full and final clearance of funds.

For credit card payments, delivery may be delayed until the chargeback period has expired.

From the moment of adjudication, the lot is under the full responsibility of the buyer. Buyers are responsible for insuring their purchases. ROSSINI declines all responsibility for any damage occurring after adjudication.

In the case of sales held at Hôtel Drouot, storage fees shall also be borne by the buyer.

6. SHIPPING

Shipping is entirely at the buyer’s risk and responsibility.

The buyer is responsible for selecting the carrier and organizing transport.

ROSSINI may provide contact details of carriers on a non-binding basis.

Lots will only be released after full payment has been received.

Export license procedures may require a period of 4 to 5 months.

7. ONLINE BIDDING

Participation in online bidding is a convenience service. ROSSINI does not guarantee uninterrupted, secure, or error-free operation of online platforms.

ROSSINI shall not be liable for:

  1. service interruptions or failures,
  2. technical issues, bugs or maintenance,
  3. internet delays, latency or transmission errors,
  4. display or communication errors,
  5. or any technical incident affecting participation.

Bidders acknowledge that live video streams may be subject to delay compared to the actual auction.

In case of dispute, only the official auctioneer’s record shall prevail. In-room bids take precedence over online bids.

ROSSINI reserves the right to:

  1. suspend, interrupt or resume bidding,
  2. withdraw, combine or divide lots,
  3. cancel the online broadcast,

without notice and without liability.

Participation in online bidding is at the bidder’s own risk.

8. EXPORT

This sale is conducted under the margin VAT scheme. No invoice showing VAT can be issued.

VAT exemption (intra-community supply or export outside the EU) will only be granted upon receipt of valid and final export documentation.

For exports outside the European Union, the IE599 customs document is mandatory.

No VAT refund or exemption will be granted without these documents. Failing this, the invoice will remain inclusive of all taxes, with no possibility of subsequent adjustment.

The buyer is solely responsible for:

  1. completing all customs and tax formalities,
  2. complying with export deadlines (maximum three months),
  3. ensuring compliance with import regulations of the destination country.

ROSSINI shall not be liable for:

  1. customs delays or refusals,
  2. export restrictions,
  3. additional taxes or duties,
  4. or inability to export.

The use of a carrier or intermediary is at the buyer’s sole responsibility.

9. BIDDER IDENTIFICATION (KYC)

Bidders must provide accurate, complete and up-to-date identification information.

ROSSINI reserves the right to request supporting documents and to refuse participation or delivery in case of doubt.

Information provided by the bidder is binding and definitive.

No changes to identity, billing or delivery details will be accepted after adjudication.

All purchases are deemed to be made in the name of the registered bidder. No transfer of ownership or invoicing will be accepted after the sale.

ROSSINI reserves the right to cancel a sale or suspend delivery in case of non-compliance or suspected fraud.

10. PAYMENT

Cash payments are limited to:

  1. €1,000 for French residents and professionals,
  2. €15,000 for non-resident individuals (with valid proof).

No splitting or mixed payments are allowed.

Payment by cheque: lots released only after clearance.

Payment by bank transfer: lots released only after funds are received.

Proof of transfer is not considered as payment.

ROSSINI reserves the right to refuse any payment in case of doubt.

11. BANK CHARGES – EXCHANGE RATES

All bank charges, transfer fees and exchange costs are borne exclusively by the buyer.

The amount received must correspond to the full invoice amount.

12. TRANSFER OF RISK

From the moment of adjudication, the lot is under the full responsibility of the buyer.

All risks (loss, theft, damage or destruction) are transferred at the fall of the hammer.

13. LOT DESCRIPTIONS

Catalogue descriptions are made in good faith based on current knowledge.

They may be subject to corrections announced during the sale and recorded in the official minutes.

They are indicative only and do not engage liability beyond legal guarantees.

INFORMATION NOTICE

PAYMENT INCIDENTS – TEMIS DATABASE

Any unpaid or late-paid invoice issued by ROSSINI may result in registration in the Auction Access Restriction Database (“TEMIS”), operated by Commissaires-Priseurs Multimédia (CPM), whose registered office is located at 37 rue de Châteaudun, 75009 Paris, France, registered under number 437 868 425.

The TEMIS database may be accessed by all auction houses in France subscribed to this service.

Registration may result in restrictions on the bidder’s ability to participate in auctions and may lead to temporary suspension of access to online live bidding platforms such as Interencheres.

ROSSINI may require specific guarantees or refuse participation in auctions for bidders listed in the TEMIS database.

Bidders may exercise their rights of access, rectification, erasure or objection by submitting a written request with proof of identity:
