TERMS AND CONDITIONS OF SALE
The sale will be conducted in Euros and is payable immediately.
The buyer’s premium amounts to 28.8% incl. VAT, to which a 1.8% live fee will be added for bids placed online.
1. WARRANTIES
Attributions and period designations are made based on the current state of scholarly and artistic knowledge at the date of the sale. These attributions are guaranteed for a period of five (5) years from the date of adjudication.
The statutory limitation period for bringing a claim against the auction house ROSSINI is five (5) years.
The order of the catalogue will be followed.
ROSSINI may provide, upon request, condition reports and photographs enabling buyers to assess the condition of the lots. No claims will be accepted once the hammer has fallen.
Catalogue illustrations are as accurate as possible; however, variations in color or tone may occur. Dimensions are given for guidance only.
ROSSINI is covered by professional liability insurance and financial guarantee as required by law. All experts are likewise covered by professional liability insurance.
2. BIDDING
Absentee bids (except online-only sales):
If you wish to submit a written bid, you may use the form provided at the end of the catalogue. It must be received at least 24 hours prior to the sale and be accompanied by your bank details and a valid ID.
Absentee bids are a service provided to clients unable to attend the sale.
The Auction House will endeavor to execute bids under the best possible conditions. However, it accepts no liability for any omission, error, failure to execute or improper execution of such bids, regardless of cause.
In the event of identical absentee bids, priority will be given to the first received.
3. DEFAULT OF PAYMENT
In the event of non-payment or late payment exceeding 30 days, penalties amounting to 11.37% incl. VAT of the total invoice will be applied.
ROSSINI reserves the right to initiate any recovery action, including registration in the TEMIS database, and to claim damages covering at least the buyer’s and seller’s fees not received.
4. RESALE AT THE DEFAULTING BIDDER’S RISK
In accordance with Article 14 of the Law of July 10, 2000:
“In the event of non-payment by the successful bidder, after formal notice has remained ineffective, the property may be resold at the seller’s request at the defaulting bidder’s risk. If the seller does not make such a request within two months of the sale, the sale shall be automatically cancelled, without prejudice to damages owed by the defaulting bidder.”
5. COLLECTION OF PURCHASES
Buyers are advised to collect their lots promptly in order to avoid storage fees, which shall be at their expense. Storage does not engage the liability of ROSSINI or the expert.
For all buyers (in-room, online or absentee), storage fees will apply from the 20th day following the sale (excluding weekends and public holidays):
- €5 excl. VAT per day per item
- €10 excl. VAT per day per piece of furniture
Collection is strictly by prior appointment.
Certain bulky items may not be available at ROSSINI premises and will be stored at our logistics center in Montargis, available by appointment only.
In the event of payment by cheque or bank transfer, delivery of the lots may be delayed until funds have been fully cleared and received.
For credit card payments, delivery may be delayed until the chargeback period has expired.
From the moment of adjudication, the lot is under the full responsibility of the buyer. Buyers are responsible for insuring their purchases. ROSSINI declines all responsibility for damage occurring after the hammer has fallen.
6. SHIPPING
Shipping is entirely at the buyer’s risk and responsibility. The buyer is responsible for selecting the carrier and organizing transport.
ROSSINI may provide contact details of carriers on a non-binding basis.
Lots will only be released to carriers after full payment has been received.
Export license formalities may require a delay of 4 to 5 months.
7. ONLINE BIDDING
Participation in online bidding is provided as a convenience service. ROSSINI does not guarantee uninterrupted, secure, or error-free operation of online platforms.
ROSSINI accepts no liability for:
- service interruptions or failures,
- technical issues, bugs, or maintenance,
- internet connection problems, delays, latency or transmission errors,
- display or communication errors,
- or any technical incident affecting online participation.
Bidders acknowledge that live video streams may be subject to delay compared to the actual auction. Bidding is therefore at the bidder’s own risk.
In case of dispute, only the official auctioneer’s record shall prevail. Bids placed in the auction room take precedence over online bids.
ROSSINI reserves the right to:
- suspend or resume bidding,
- withdraw, combine or divide lots,
- cancel the online broadcast,
without notice and without liability.
8. EXPORT
This sale is conducted under the margin VAT scheme. Therefore, no invoice showing VAT can be issued.
VAT exemption (intra-community supply or export outside the EU) will only be granted upon receipt of valid and final export documentation.
For exports outside the EU, the IE599 customs document is mandatory.
No VAT refund or exemption will be granted without these documents. Failing this, the invoice will remain inclusive of all taxes, with no possibility of subsequent adjustment.
The buyer is solely responsible for:
- completing all customs and tax formalities,
- complying with export deadlines (maximum three months),
- ensuring compliance with import regulations of the destination country.
ROSSINI shall not be liable for:
- customs delays or refusals,
- export restrictions,
- additional taxes or duties,
- or inability to export.
9. BIDDER IDENTIFICATION (KYC)
In compliance with anti-money laundering regulations, bidders must provide accurate and up-to-date identification information.
ROSSINI reserves the right to request supporting documents and to refuse participation or delivery in case of doubt.
No changes to billing or identity details will be accepted after adjudication.
10. PAYMENT
Cash payments are limited to:
- €1,000 for French residents and professionals,
- €15,000 for non-resident individuals (with proof).
No payment splitting or mixed payment methods are allowed to bypass legal thresholds.
Payment by cheque: release only after full clearance.
Payment by bank transfer: release only after funds are received. Proof of transfer is not sufficient.
ROSSINI reserves the right to refuse any payment in case of doubt.

PAYMENT INCIDENTS – AUCTION ACCESS RESTRICTION DATABASE (TEMIS)
Any invoice (buyer’s statement) issued by ROSSINI SVV that remains unpaid or is subject to late payment may result in registration in the Auction Access Restriction Database (“TEMIS Database”), managed by Commissaires-Priseurs Multimédia (CPM), a public limited company with a management board, whose registered office is located at 37 rue de Châteaudun, 75009 Paris, France, registered with the Paris Trade and Companies Register under number 437 868 425.
The TEMIS Database may be consulted by all auction houses operating in France that are subscribed to this service. The list of subscribers to the TEMIS service is available on the relevant platform under the section “Buying at auction” → “Auctioneers”.
Registration in the TEMIS Database may result in restrictions on the bidder’s ability to participate in auctions conducted by professionals subscribed to the TEMIS service. It may also lead to the temporary suspension of access to the “Live” bidding service on the platform https://interencheres.com , in accordance with its terms and conditions.
Where a bidder is registered in the TEMIS Database, ROSSINI may:
- require the use of specific payment methods or guarantees as a condition for participation,
- or temporarily refuse the bidder’s participation in auctions where such guarantees cannot be implemented.
Bidders wishing to determine whether they are registered in the TEMIS Database, to contest such registration, or to exercise their rights of access, rectification, erasure, restriction or objection under applicable data protection laws, may submit a written request accompanied by proof of identity (copy of a valid ID):
