Terms and Conditions of Sale – Rossini Auction House
The sale will be conducted in cash and in Euros. The buyer’s premium is 30.6% incl. VAT, which includes the 3.6% fee charged by Drouot Online.
1. GUARANTEES
Attributions, including period indications, are established based on the current scientific and artistic knowledge at the time of the sale. These attributions are guaranteed for a period of five (5) years from the date of the auction. The statute of limitations for any liability claim against ROSSINI Auction House is five (5) years.
The catalogue order will be followed. Rossini will provide, upon request, photographs and detailed information to help potential buyers assess the condition of the items offered. No claims will be accepted once the lot has been adjudicated.
Reproductions of works in the catalogue are as faithful as possible; however, variations in color or tone may occur. The dimensions are provided for information purposes only.
ROSSINI Auction House is covered by professional liability and financial guarantee insurance in accordance with the law. All our experts are also covered by professional liability insurance.
2. BIDDING
Absentee bids: (except Online sales) If you wish to leave an absentee bid in writing, please use the designated form at the end of the catalogue. It must reach us at least 24 hours before the sale, along with your banking details.
3. PAYMENT DEFAULT
In the event of a default or delay in payment exceeding 30 days, a late penalty of 11.37% incl. VAT of the total amount will be applied.
Rossini reserves the right to take any recovery actions, including registration in the TEMIS restricted access file, and to seek damages covering, at a minimum, the seller’s and buyer’s fees that would have been collected had the sale been completed successfully.
4. RE-SALE (FOLLE ENCHÈRE)
By derogation from Article 14 of the Law of July 10, 2000:
"In the event of non-payment by the buyer, after a formal notice has remained unanswered, the lot may be re-offered for sale at the request of the seller by means of a new auction (folle enchère) at the expense of the defaulting bidder. If the seller does not make such a request within
two months
from the adjudication, the sale will be automatically cancelled, without prejudice to any damages owed by the defaulting bidder."
5. COLLECTION OF PURCHASES
Buyers are advised to collect their lots only by appointment as soon as possible to avoid storage fees, which are the sole responsibility of the buyer.
Storage does not imply any liability on the part of Rossini Auction House or the expert.
For all buyers (on-site, online, or absentee bidders), storage fees will apply starting from the 21st calendar day after the sale (excluding weekends and public holidays):
- €5 excl. VAT per day per item
- €10 excl. VAT per day per piece of furniture
If payment is made by cheque or bank transfer, delivery may be delayed until the funds are cleared.
Please note that certain bulky or oversized lots can only be collected from our logistics center located in Montargis, by appointment.
For card payments, delivery may be postponed until the withdrawal period has expired.
From the moment of adjudication, the item is under the entire responsibility of the buyer. It is the buyer's responsibility to insure their purchases. Rossini Auction House declines any liability for damage or loss incurred after the auction.
In the case of sales held at the Hôtel Drouot, storage fees are borne by the buyer.
6. SHIPPING OF LOTS
Transportation is entirely the buyer’s responsibility.
The buyer is responsible for choosing and organizing shipment.
Rossini Auction House may provide, for convenience only and with no contractual obligation, contact details of transport companies.
No lot will be handed over to a shipper until the purchase has been paid in full.
The issuance of an export license may take 4 to 5 months.
7. ONLINE SALES
Online sales are subject to the same terms and conditions as in-room auctions. However, Rossini Auction House cannot be held responsible for any technical disruptions, connection issues, system failures, or platform outages that may affect the transmission or execution of bids via online platforms such as Drouot Online or Interencheres Live.
Buyers acknowledge that participation in an online auction does not guarantee the successful placement or receipt of their bids, and that technical problems may occur independently of Rossini's control.
8.EXPORTATION
VAT-exempt invoices (for intra-community deliveries or exports outside the EU) will only be issued upon receipt of valid export documentation. Otherwise, the invoice will be issued inclusive of VAT. The buyer is solely responsible for completing the export formalities within the legal time limits.
NOTICE – PAYMENT INCIDENTS
RESTRICTED ACCESS FILE FOR AUCTION SALES (TEMIS)
Any unpaid auction invoice issued by ROSSINI Auction House, or subject to delayed payment, may result in registration in the Restricted Access File for Auction Sales ("Fichier TEMIS"), managed by the company Commissaires-Priseurs Multimédia (CPM), a joint-stock company with an executive board, headquartered at 37 rue de Châteaudun, 75009 Paris, and registered with the Paris Trade and Companies Register under number 437 868 425.
The TEMIS file is accessible to all auction houses operating in France and subscribed to this service. The list of subscribers is available at:
, menu “Buy at Auction” > “Auctioneers”.
Consequences of being listed in the TEMIS file:
- It may limit the bidder’s ability to participate in auctions held by professionals subscribed to TEMIS.
- It may suspend access to the Live service of interencheres.com, in accordance with the platform’s general terms of use.
- If a bidder is listed in the TEMIS file, Rossini may require specific payment methods or guarantees to authorize participation in future auctions, or temporarily refuse access to sales where these guarantees cannot be applied.
Data protection rights – RGPD
Bidders who wish to:
- check if they are listed in the TEMIS file,
- contest their registration, or
- exercise their rights (access, rectification, erasure, restriction, objection),
may contact the relevant party, providing a copy of their ID:
