Le Trosne (1728-1780), magistrate at the presidial court of Orléans and disciple of Quesnay, the leader of the physiocratic movement, unveils here proposals to reform or rather create a new criminal justice: as for our Loix pénales, it is not properly a legislation to be reformed, but rather to be created . As for our Loix pénales, it is not strictly a law to be reformed, but to be created... The disorder in this very important section is such that one is not sure where to take these Loix (p. 126). According to him, the social interest must be combined and reconciled with the rights of the accused citizen; moreover, sentences must be proportionate to the offences and be fixed by the laws and no longer left to the sole arbitration of judges.
